How did he do it? With YouTube, that’s how. Kissed in his cradle by the witch of the Web, Justin was throwing up little promo reels by the time he was 12. Singing a Brian McKnight song into the bathroom mirror. Or sitting on some municipal steps somewhere, busking mightily about the Lord: “You’re my God and my Fa-ther!” he bellows through the legs of passersby, the wooden body of his guitar reverberating with his shouts. ...


Bieber wasn’t from the Disney factory, and he didn’t have a show on Nickelodeon, so the marketing plan was skewed toward his already established constituency in social media: lots of Facebooking and YouTubing and sugary tweets to his millions-strong Twitter army.

In February of 2007, 83.24 percent of users visiting TechCrunch did so from a Windows machine. One year later, in February 2008, the stranglehold remained firm at 80.44 percent. In February 2009, the number was at 74.04 percent. Last year, it was 61.59 percent. And this year? The number of people visiting our site from Windows machines dipped to 53.84 percent.


The writing is on the wall.


Look at those numbers again for a second. In four years, Windows share among TechCrunch readers has fallen 30 percentage points. That’s incredible.


The knee-jerk reaction in the comment section will likely be something like “it’s because you guys cover Apple so much”. But the fact of the matter is that Macintosh share, after rising for three of those four years, fell last year as well. It’s the mobile devices — specifically the iPhone, iPad, and Android devices — that are eating away at Windows.


In fact, if the trend over the past four years continues at about the same pace, in two years, devices made by Apple (Macs, iPhones, iPod touches, and iPads) will surpass devices that run Windows as the top visitors to TechCrunch. And depending on how popular the iPad 2, iPhone 5, and OS X Lion are, it could easily happen next year.

While even the last batch of stats shows that Windows still has a nice cushion over number two, Mac, if you add the Apple products put together, it’s a different story.

In the four year span, Apple has added 25 percentage points to their share among TechCrunch readers. That nearly all of the 30 percentage points that Windows lost in that same span (Android’s growth pretty much fills in the rest).


So it currently stands at Microsoft’s 53.84 percent versus Apple’s 38.42 percent. Again, a big year for iPad, iPhone, and Mac could mean a changing of the guard as soon as next year. But unless something drastic changes, you can be sure that Apple will be dominant among TechCrunch readers in two years.


The latest rumors have Windows 8 showing up sometime in mid/late 2012. But the fact of the matter is that Windows 7, much more widely praised than the disaster that was Vista, hasn’t helped Microsoft buck this trend among our readers. Perhaps they’re only hope of gaining back share at this point is Windows Phone. So far, that hasn’t been going too well. Nokia should help that, but will it be enough to offset the Windows losses?


Humorously, Microsoft’s best hope for not falling to Apple may well be Android. If Google’s platform continues to make gains, it could prolong Apple passing Microsoft.


But again, Apple has iPhone 5, iPad 2, and OS X Lion on the immediate horizon — all within the next few months. And then there’s the very real possibility of another iPad in the fall.


The iPad 2 and iPhone 5 are likely to push the Apple share forward immediately. But don’t sleep on OS X Lion either. The early indications are that Apple has indeed made it much more iOS-like. That means millions of iPad/iPhone/iPod touch owners who have traditionally been PC users, are going to feel a lot more comfortable on a Mac than ever before.


And a new PC-to-Mac data migration system built in to Lion will only help that.


OS X Lion is going to feed off of iOS users, and vice versa. And the Mac ecosystem is going to continue to expand. Just as happened in the browser world with Chrome taking over, a transition is happening among TechCrunch readers in the ecosystem space. The numbers don’t lie. And Microsoft better pray that our readers aren’t leading indicators of overall trends in the space — which is exactly what you have been in the past.




For Apple, the mobile market is a cash cow. The company’s iPhone and iPad are proving to be the top mobile companions for people around the globe. Apple has sold over 100 million iPhones. Its iPad sales have hit 15 million. The company understands the mobile market and it knows how to capitalize on it.




But what about the living room? It has the Apple TV, sure, and the Mac mini is often times connected to an HDTV, but what else has Apple done to push the envelope in the living room? It still hasn’t launched the long-rumored television we keep hearing about, and it seems that offering a game console — a hope for many Apple fans over the past few years — won’t happen.


I fully realize that Apple can’t be everything to every customer. It delivers computers, smartphones, tablets, personal media players, two operating systems, wireless routers, and much more. But I also realize that Apple is an entertainment company. It’s about trying to give people more opportunity to enjoy their lives through technology. And it would only make sense if it doubled down on the living room.


Let’s turn our attention to the Apple TV for a minute.


Prior to its announcement in September, rumors were running rampant over what the former “hobby” would offer. Folks thought it would deliver gaming, interface with DVRs, include Apple’s App Store, and much more. They thought it would be a sizable update over its predecessor.


Instead, Apple offered a stripped-down alternative.


The second-generation Apple TV comes with the ability for users to stream Netflix content. It has Flickr and Internet radio. And it allows users to stream their music over their home network to their televisions. It offers movies and television shows, as well, but most would agree that it’s slim pickings for now.


At that event in September, Steve Jobs said that Apple’s research showed customers didn’t want everything a company could pile into a device. They simply want the ability to consume the content they enjoy without the fuss that might come along with something like Google TV-based devices.


But by delivering the bare minimum, Apple did itself no favors. The company took the easy way out and pretended like it no longer views the living room as a hobby. The only issue is, the Apple TV is still a hobby. It’s a device that lacks all the functionality we’ve come to expect from Apple — a company that typically prides itself on offering the best value for the cash. And at least so far, it leaves me wanting more.


So, what am I looking for? I want to see Apple improve the Apple TV by bringing its App Store to the platform. I’d also like to see some kind of gaming component come to the device, either through the App Store or as part of a more-capable platform.


And perhaps most importantly, I’d like to see Apple think beyond its set-top box and deliver products that try something new. I’m not sold on the possibility of Apple offering a groundbreaking television, but if it can surprise me, I’m all for it.


Simply put, I’m looking for Apple to be Apple. Right now, it’s just like every other company in the living room; it’s content to have a presence but not dominate.


That needs to end.


No single company can stake claim to the living room right now. Steve Jobs just needs to take advantage of that void and do something special.


But first, he needs to take the living room — and its revenue potential — seriously.

What’s affecting me, my clients and other small-business owners this week.


THE QUAKE IN JAPAN, A GOOFBALL IN VENEZUELA Japanese earthquake damage is estimated at $310 billion and could be the costliest natural disaster ever. Japanese exports suffer. Kate Rogers of Fox revisits how to protect your business from catastrophe. “Small-business owners can determine if they should be seeking disaster coverage by weighing their investment in the business itself, among other factors. If the business is the sole form of income, the risk is much greater than if it is a hobby or part-time project.” Elsewhere around the world, the war industry gets a boost in Libya. And Hugo Chávez of Venezuela says capitalism may have destroyed life on Mars.


REAL ESTATE FALLS, JOBS RISE Mark Thoma says commodity prices are increasing because of world demand. A small-business owner in Georgia is trying not to pass on the cost of high gas prices. Detroit’s population declines 25 percent. Existing-home sales fall to the lowest on record. Meredith Whitney, an investment adviser, says, “Unless the government comes out with a 50-year mortgage, this market is in trouble longer term.” Gallup’s job-creation index is the highest since September 2008. Durable goods orders fall.


ANNE HATHAWAY AND WARREN BUFFETT The Fed earns $79 billion and predicts that the recovery is taking hold. Nonetheless, one of its officials warns that the United States is approaching insolvency. Meanwhile, Warren E. Buffett predicts growth but some think his company’s stock is buoyed by Anne Hathaway. Household balances sheets continue to improve. Scott Grannis says “the Philadelphia Fed Business Outlook Survey came in very strong. It hasn’t been this strong since the economic boom times of the early 1980s. It’s very difficult to ignore the mounting evidence of a strong economic recovery.” Architect billings increased slightly in February.


DEFICIT THRILLS The Committee for a Responsible Federal Budget is thrilled to see 64 senators calling for comprehensive deficit reduction. But Stan Collender, a budget expert, isn’t thrilled at all: “Does a letter that is so vanilla that it could have been written at any time over the past 40 years really indicate any movement on the current budget debate?” James Pethokoukis of Reuters says he thinks President Obama’s budget is wildly dangerous.


A NEW DEFINITION OF SMALL BUSINESS Timothy F. Geithner says that American small businesses need greater access to capital to spur innovation. The Small Business Administration, facing even more cuts, is for the first time in more than 25  years proposing to change the way it defines small businesses. JPMorgan Chase says it will cease its debit card rewards program because of new legislation that would restrict fees. Missouri gets $27 million in incentives for small-business growth. The Small Business Savings Account Act makes its way through Congress.


TAKING CREDIT The health care legislation celebrates its first anniversary and Ezra Klein defends it by saying, “Is it a perfect piece of legislation? Not even close. Will everything work as expected? Almost certainly not. But for all its flaws, it’s a good law. And it’s worth trying.” Many small businesses are still not taking advantage of the health care tax credit.


TECHNOLOGY UPGRADES A Google project manager pitches cloud computing: “Web-based software is much less costly for buyers than traditional software, and programmers can be so much more innovative, that it’s worthwhile for an entrepreneur to say, O.K., let’s start from scratch.” Paul Mah, an information technology expert, gives us eight reasons to upgrade to Internet Explorer 9. Firefox 4 is released. Microsoft jumps to second in video search and introduces a new PC tool for small business. Netflix suffers an outage. BlackBerry’s tablet is scheduled to arrive in April. AT&T buys T-Mobile but not for the reason you think. And boy. has computer technology come a long way in 10 years.


THE GROWING APPS MARKET Information Week reports that 38 percent of small- and medium-size businesses depend on mobile apps. Amazon introduces an Android app store, and Apple is not pleased. Minda Zetlin of Inc. asks if you should make a tablet app for your business: “The answer is likely a yes if one, your product or service is one where having tablet access could benefit customers; and two, your customers are the type who use tablets.” Just in time: a flood of royal wedding apps.


SPEAKING OF THE BIG WEDDING General Electric releases a much-needed William and Kate refrigerator. Jack Daniels introduces a new product — perhaps to help us forget the royal wedding. Danny Wong gives us three winning ideas to consider. A dating site features a new single man every day. Score plans an e-business learning Web site for small business. Small Business Television is rebranding itself and has introduced a new Web site. Small Business Opportunities magazine is doing the same. A small business introduces its first electric car. Sales of e-books have doubled. The group buying industry is projected to grow to $2.7 billion this year.


TWITTER’S TAX BREAKS Casey Hibbard explains how one company used social media to make $300,000 in a weekend. Robert Scoble discovers the future of work: “Just when we thought we figured out the new ’social enterprise’ market along comes Convofy.” Twitter shows San Francisco’s businesses how to save a bundle on taxes. A one-legged wrestler shows us how to become a national champ.


IT’S GOOD TO BE GREEN A woman in Canada gets a standing ovation for being green. The Manhattan Chamber of Commerce holds its green marketing event on Wednesday. The Clinton Global Initiative holds its university conference this week with a focus on entrepreneurship and a live webcast.


ADVICE FOR SXSW: HAND OUT PILLOWS The Global Entrepreneurship Congress meets in Shanghai this week. April 2 is International Pillow Fight Day. The South By Southwest conference: as seen from a bunch of social media video bloggers — which is yet another reason I won’t attend next year. American Airlines offers a big promo for California business travelers. John Jantsch wants to know the worst business advice you ever received. A third-base coach gives life advice.


SEARCHING FOR HELP WITH SEARCH An American Express survey finds that more than half of small-business owners say they need help with search-engine marketing. A video about why it’s not important to go viral goes viral. Dharmesh Shah shares a few low-cost advertising ideas for start-ups and cautions readers to “think of advertising not as a long-term traffic strategy but as a testing tool to improve your Web site and find out more about your ideal visitor.” An advertising blog discusses how to develop a relationship with the media. A 100-MILLION-MEMBER NETWORK LinkedIn officially reaches 100 million members. Seems like a good time to read the co-founder’s 10 rules for entrepreneurial success.

Conservative Conference Warns Of Hidden Islamic Danger In ‘Race To The Top’ Funding


A new memo that has been making the rounds in conservative circles is a dire warning about an onslaught of Islamic “Gulen schools,” a growing international network of charter schools begun in Turkey that offer “a blend of religious faith and largely Western curriculum.”


At the Educational Policy Conference, a large gathering of social conservatives in St. Louis in January, prominent neoconservative and anti-Muslim conspiracy theorist Frank Gaffney, and former Colorado State Board of Education member Peggy Littleton sounded the alarm on the “creeping threat” of Gulen schools hidden in President Obama’s landmark education initiative, the Race to the Top program, which encourages innovation in education, including charter schools. Littleton, who currently serves as an El Paso County Commissioner, told conference-goers that “the only reason [Obama is] pushing more charter schools” through Race to the Top is “because of these Gulen schools.”


ThinkProgress caught up with Littleton after her speech. She told us that the Obama administration “intentionally had already thought through how they could have a proliferation and a sneaking creep, if you will, of Gulen schools by embedding their acceptance and even promotion of charter schools under this new wonderful thing of Race to the Top.” She warned that these schools were teaching our children to “hate Americans.” Watch it:



Not to be outdone, Gaffney told the audience that, along with the federal government and CPAC, Gulen schools were “another example of this Muslim Brotherhood kind of operation, stealth jihad.” Completing Fox News host Glenn Beck’s “worldwide Muslim caliphate theory,” Gaffney also declared that Fethullah Gulen, the namesake of Gulen schools, “is a fellow who I think envisions himself being the next Caliph.” He finished by calling Gulen schools “an insidious, seditious program” and called on conference-goers to spread the word to friends and elected officials. LITTLETON: If you’ve done any research on Gulen schools, you need to get on the Internet and do some. Because I believe – and this is just my own personal opinion without any factual data to back it up – one of the only reasons the Obama administration is willing to stand in the face of teacher’s unions, who supported his campaign with large numbers by the way. The only reason he’s pushing more charter schools, even in the face of teachers unions, is by making states adopt charter school rules that are open and who are applying for Race to the Top funds, I think that he’s doing that because of these Gulen schools. The Gulen schools are the Muslim schools in our country. I’m showing you how many of them are already operating, you can see there’s 107 of them. Twelve of them are opening in 2010, nine are pending, 22 were declined. There are over 150 schools in the United States that are already out there that are telling the kids of the United States of America, “hate Americans and the whole rest of the…” and you’ll hear more about that tomorrow, I’m excited you’re going to get to see that.


KEYES: Do you think the administration anticipated the rise in Gulen schools as a result of Race to the Top education money?


LITTLETON: I don’t think they tied it to the money in any way, shape or form. But I do think they intentionally – and again, this is my own opinion – but I think they probably intentionally had already thought through how they could have a proliferation and a sneaking creep, if you will, of Gulen schools by embedding their acceptance and even promotion of charter schools under this new wonderful thing of Race to the Top and “let’s fund the schools this way.” Even though there’s not really the direct funding source, I think it was the intention to promote charter schools.


KEYES: Couched in very flowery language.


LITTLETON: Absolutely.


KEYES: Why do you suppose they want to do that?


LITTLETON: Well, there’s going to be speculation, by everyone that’s out there. You yourself I’m sure have done the research, you’ve seen and heard some of the things our own president has said about the Muslims. You’ve heard that he thinks we ought to be friendly to some of their causes, that we should be tolerant in promoting some of the Muslims that are scientists and technology people. I think we need to go back and research what our president has said and by his own words and admissions, I think you can probably make the connection.

GAFFNEY: As to this question about a Turk by the name of Gulen, this is one of those little-known stories that I’m thrilled that you’ve mentioned because it is another example of this Muslim Brotherhood kind of operation, stealth jihad. This is a fellow who I think envisions himself being the next Caliph. He is enormously influential in his native Turkey, where he has helped instigate, essentially, an Islamist takeover of the country with a wholesale repudiation and replacement of Ataturk’s secular form of government with one that is through-and-through Islamist. And that’s now increasingly making common cause with Iran, with Syria, with Hezbollah, with Hamas, which is very clearly hostile to Israel, which Turkey was until recently strategic partners with. In short, it is headed in a very dangerous direction indeed, Turkey is. This guy, Gulen, has been extending his influence by building large numbers of these schools all over the world. And the really extraordinary thing is he’s doing so from a safe haven in Rick Santorum’s great state of Pennsylvania. For a time his operation was considered a terrorist group, until inexplicably the Clinton administration decided it wasn’t anymore. And so he is churning out an insidious, seditious program from within the territory of the United States. And I would venture there isn’t one member of Congress today who has ever heard of his name, let alone understands what he is up to. While I think both products will evolve over time, this space is still extremely nascent.


The Future


The convergence of local, mobile, and social (or “SoLoMo” as John Doerr calls it) is about to generate a tidal wave of change and we stand on the cusp of it. While I could wax poetic about the future of this space, I’ll simply say that the overall shopping experience will become much more social for a large percentage of transactions. If you think about all the purchases that involve social experiences (movies, concerts, travel, etc), these spaces are only beginning to get disrupted.


While the experiences are social, right now the transactions are not. So far the only social shopping experiences which exist today either provide basic integration with Facebook, sidebar chat with friends during the shopping experience, or other basic features. Over the next one to two years, we will see a wave of innovation in the social commerce space and it won’t be like the forms of interactions we have on the web; they will be completely different. While it’s easy to call the Groupons of the world overvalued, this is a trillion dollar market that is just beginning to unfold.

In a separate incident on Oct. 12, it said, Nuermaimaiti Aobulikasimu and 11 others broke into a house, bound and killed the couple living in it, and took their possessions.

 

It said the group also broke into the homes of two brothers, robbed them, and killed six people in a Nov. 11 attack in Kashgar.

 

The report gave no information about the victims or the schedule for the executions.

 

Three of the men were sentenced to death with a two-year reprieve, a sentence that is normally commuted to life imprisonment in China's judicial system.

 

They were convicted of deliberate homicide and armed robbery by the Kashgar Intermediate People's Court in the first instance.

"We are also strongly opposed to the death penalty in this case."

Last month, the Supreme Court sentenced four Uyghurs to death for alleged involvement in an Aug. 19 bomb attack in Xinjiang’s western Aksu city.

 

The World Uyghur Congress pointed to concerns over lack of transparency in those cases too.

 

The Aksu blast left eight people dead, including two of the bombers, and 15 wounded after a man riding a three-wheeled vehicle threw explosives at a group of uniformed patrolmen. Four Uyghurs were arrested shortly after the attack.

 

State media characterized the cases as acts of terrorism and unrelated to longstanding ethnic tensions between Uyghurs and Han Chinese in the region.

Millions of Uyghurs—a distinct, Turkic minority who are predominantly Muslim—populate Central Asia and Xinjiang.

 

Uyghurs say they have long suffered ethnic discrimination, oppressive religious controls, and continued poverty and joblessness despite China's ambitious plans to develop its vast northwestern frontier.

 

Those frustrations erupted in July 2009 in deadly riots that left nearly 200 people dead, by the Chinese government's tally.

 

At least 26 people, mostly Uyghurs, were sentenced to death in the aftermath of the riots, many of whom have been executed, according to state media.

 

China is believed to execute more people each year than the rest of the world’s countries combined, although the government does not publish official figures.

 

Rights groups say Beijing may execute as many as several thousand prisoners annually.

 

Chinese authorities blame Uyghur separatists for a series of deadly attacks in recent years and accuse one group in particular of maintaining ties to the al-Qaeda terrorist network.

"From the point of view of ethnic minorities, the graduate work scheme is really taking the cream of youth from the minorities and using them to 'further cultural development,'" wrote one ethnic minority user on a popular microblogging service.

Making Money Work

Housing Wire’s Paul Jackson has another post up continuing his row with Yves over securitization chain of title issues. It presents itself as a rebuttal of her previous post, about an Alabama trial court decision that Jackson deems to be a significant defeat, but which Yves and more recently Adam Levitin have argued is both insignificant and not very relevant.


Normally I’d leave the two of them to slug it out. However, Jackson’s weekend submission, in which he says he is “going to address her latest talking points” piqued my interest. Rather than addressing any of the substance of the post itself, he mounts a bizarre attack on the motives of the attorneys behind the Alabama case, based on a pretty peculiar interpretation of one of Yves’ comments to the post. The comment:


Are you kidding? Each side spent over $250K on this case. Trials where you are making real legal arguments, as opposed to presenting papers for a judge to approve, are costly. And Alabama billing rates are a lot lower than in other states. For borrower’s counsel, since the borrower has no money, the “spent” is what their time was worth plus hard dollar expenses (experts witnesses and so on). They are out the real out of pocket real costs.


The banks’ lawyer gets paid, so yes, this is an epic fail for the bank. I’ve mentioned this in other posts. The more borrowers fight cases, the more loss severities are gonna rise. Investors already are losing 70% on the average foreclosure and housing prices are projected to fall further in most states this year. If on top of that they start having more cases with 300% losses on foreclosure, investors might wake up and finally do something a lot more serious to pressure servicers.


Sooo…bank attorneys run up a tab fighting a foreclosure in a pretty obscure courthouse, that results in a 300% loss to investors, when all the borrower’s attorney wanted was the house back and a loan modification. The big numbers are the result of the bank attorney’s posture, and of eleventh hour moves that many judges would have rejected: introducing an allonge on the eve of the trial. This was clearly a bad economic result for the borrowers’ attorney! It was not hard to see that the trial had become a war of escalation, with the bank’s attorney in an ideal position to up the ante. The post makes clear that unlike the bank’s lawyers, borrower’s counsel was “out”, in hard dollar terms, vastly less than the total, which would have to include the opportunity cost of unpaid for billing time.


For Jackson this somehow becomes the basis for a statement of his worldview: that everyone is greedy, ergo these attorneys must be too! In his own words:


Morality and the accompanying emotions to that noble love of justice are simply a varnish for the fires of greed. In other words, everything is about the money, and if you can find a viable angle to make more of it than someone else. And I mean everything.


Taking guidance from this exceedingly dubious, indeed self-refuting claim (if it’s all about the money, we can’t trust Jackson either, can we?) is quite foolish. In fact Jackson doesn’t really believe it either: elsewhere in his oeuvre, we find a bizarre exception to his rule:


Believe it or not, mortgage servicing is a noble industry. Or, at least, it’s supposed to be. Even in managing borrower defaults and repossessing property, there is something noble to the work, underneath it all — and it comes from following the law, enforcing contracts, ensuring that our nation’s system of property rights maintains its integrity for all Americans.


Though it could be that he’s just slapping a spot of varnish, on some fires of greed, for the money; I do hope that varnish isn’t flammable, Mr Jackson, or you may decide you are underpaid.


At any rate, armed only with his distractingly inept imagery and his defective moral compass, Jackson sets out on a fishing trip, in his latest, and gets hopelessly lost almost immediately:


Yves tries to suggest that in writing about the Congress case I was claiming “Mission Accomplished,” attempting to associate me with an infamous Dubya moment during the far-from-over war in Iraq. Nothing could be further from the truth.


If you have the attention span of a gnat, you might take this at face value. On the other hand, the very next sentence says this:


Yves spends a fair amount of time suggesting that the effect of the Congress case elsewhere will be muted, if it has any effect all. In attempting to minimize the relevance of this case, however, what she misses is an important reality: that the defense here saw fit to mount one in the first place.


So make your mind up, Mr Jackson: is the case widely relevant or not?


Or was the choice of court and case, perchance, simply something of a goof by some attorneys looking to develop a theory that might have more lucrative applications? That’s one sensible conclusion you could draw, and a basic step in puzzling that out, that does not even occur to Jackson, is doing some minimal research and actually looking up the plaintiff’s lawyers. And the idea that deep pockets types would go to of all places Alabama, not exactly known for cutting edge jurisprudence or friendliness to consumers, and hire two no-name attorneys to represent a black borrower, is beyond belief. If you are Jackson, though, you skip the homework, or the sanity check, and go for the ASF paranoia:


In many ways, the plight of the distressed borrower is a convenient lever to pull if — for example— you’re a buyside Wall Street firm that decided to load up with cheap nonagency mortgage-backed securities in the wake of the market’s collapse, betting on a mechanism that could open the door to damage claims and settlements worth more than the securities themselves. Or maybe a mortgage insurer looking for novel ways to repudiate claims en masse.


I’m not at all suggesting that’s what went on here…


I have a suggestion straight back at Mr Jackson: if you want to not suggest something, the best way is simply not to make the suggestion. Otherwise, it looks as if you’re trying to have it both ways.  Keeping the accusation vague is a smart move, admittedly, if you happen to be a bit clueless and not very brave. Bill Gross for one has made the trade that Jackson mentions, but does Jackson actually mean Bill Gross? He doesn’t say. Perhaps he doesn’t want Bill Gross on his case.


Yves by contrast doesn’t care a bit, roundly dissing Mr Gross’s self interested utterances. Ultimately, Jackson is too vague to be interesting here: it’s just a smear. As for the mortgage insurer theory: there’s no evidence for that either; just Tom Adam’s prior employment history and his occasional contributions at this blog. Mortgage insurers can make claims directly, on the very same theory that Naked Capitalism and the Congressional Oversight Panel have discussed. They have no reason to test a theory on a case in a largely irrelevant jurisdiction. And there are business reasons that the monolines are going the putback case route rather than this one. Remember that most of the MBS exposure (excluding CDOs) that monolines have is via HELOCs or second liens. That may put them in a position similar to that of the big banks: unwilling to take action on the first lien mortgages for fear of write downs on the second liens.


Yes, Bill Gross and MBIA and others are out there. And if they want to work the legals to make some money, or claw some back, they, or others like them, will. It’s really hard to see why the output of “Naked Capitalism” would so heavily in their ruminations as to be worth paying for (if that is what Jackson’s insinuating: he doesn’t seem to be able to bring himself to spell it out).


All of this stuff of Jackson’s is irrelevant and pretty much content-free;  but still, it’s an interesting glimpse of sell-side anxieties.


So what really matters about this case? Three things: the unfortunate Erica Congress, who has had her hopes dashed twice over now, once when she couldn’t pay her mortgage and a second time when she was turfed out of her house; and two blithe but pernicious affirmations by the judge: first, that an allonge doesn’t have to be affixed to the note, which just opens up the floodgates for document fabrication, and second that “digital signatures” are valid endorsements to the note.


Unfortunately, neither Jackson nor the judge seem to grasp the difference between a digital signature, “a mathematical scheme for demonstrating the authenticity of a digital message or document”, as Wikipedia has it, and a digitally reproduced signature, a simulacrum that can be knocked up in minutes by any sad sack in a servicer that can use Photoshop, Word, and a laser printer, and doesn’t authenticate anything at all, least of all a transfer of title. Using 21st century technology to recreate a state of screwed-up title that hasn’t existed in anglophone countries since the mid-17th century is nothing to crow about, Mr Jackson. As a citizen of the US, it ought to make your blood run cold. It’s not just about the money.


At any rate, the more this stuff is talked about, the more lawyers (in less frivolous jurisdictions) will furrow their brows about the damage being done to the integrity of basic property transfers. So we will keep the pot boiling.


I know that memories are short on Wall Street. But are they short on Main Street too? Reading Linda Stern’s latest paean to leverage and housing risk, it certainly seems that way. Saving for a down payment is hard, she says. It can take time!


And that doesn’t seem to pay. If you think about the cost of paying rent for five or more years, you may be better off jumping into a home with a low down payment now. That’s true even if you have to spend more money on fees and mortgage insurance to get one of those low down payment loans.


Well, yes, let’s think about the cost of paying rent for five or more years. In fact, let’s plug all our numbers into a rent-vs-buy calculator and see where we’re at after five years. The problem with Linda’s formulation here is that it helps to reinforce the common fallacy that 100% of rent payments are “wasted,” in a way that mortgage payments are not. But that’s simply not true. In both cases you’re paying money every month for your shelter; in the rental case that money goes to the landlord, while in the ownership case it goes to the bank.


Some small part of your monthly payment may or may not end up helping you build equity in your home, if house prices move up rather than down and depending on how much of your payment goes towards principal. But remember that the alternative here is saving up for a down payment — which is essentially the same thing as building up equity in a future home. If you save up $250 per month for five years and then put down $15,000 as a down payment, then you immediately start off with $15,000 of equity in your home. By contrast, if you buy today with no money down and start making mortgage payments, there’s a good chance your equity will be much less than $15,000 in five years’ time.


But Linda’s on a roll here, and manages to come out with one of the most astonishing pieces of personal-finance advice I’ve seen since the crisis hit:


Even if you have the money for a bigger down payment, there can be good reasons to save your cash. Mortgage rates continue to skirt all-time lows: Why not put your money to work for yourself and borrow as much as you can reasonably afford, on a monthly basis, at today’s rates? You can put the money you’re not paying into a down payment to work elsewhere. If home values rise, you will have done your best to leverage a small down payment into bigger equity. If they fall, you’ll have less skin in the game, and that could put more pressure on your banker to improve your loan terms lest you walk away.


This, in a nutshell, is everything that was wrong with the housing market before the crash — everything that we want to avoid going forward. Can’t Linda look around at the current devastated state of many people who bought with little or no money down, and see the dangers here? Evidently not. Instead, she seems to think it’s a bright idea to borrow more money than you need, to the point at which you’re pushing the envelope of what you can reasonably afford. And then take the cash you’re not using for a down payment, and “put your money to work for yourself.”


I barely know where to start on this. Here’s one way of thinking about it: banks are not charities, and that they expect to make money from their loans. They have a cost of funds which is lower than the mortgage rate that you’re paying; the difference between the two rates is their profit. You, however, if you follow Linda’s advice, have a cost of funds which is your mortgage rate: if you wind up getting a lower return on your savings than you’re paying on your mortgage, you would have been better off just using the money for a down payment. Needless to say, if there was an easy way of getting a higher return on capital than the mortgage rate, the banks would have done it already, rather than lending you the money.
